The Government accepted the bill of a new Family code

The Government approved the new Family Code bill. The matrimonial contract and factual marital cohabitation is regulated for the first time in the Bulgarian law.
The factual marital cohabitation between a man and a woman shall have its legal significance in the presumed by the law cases such as defining fatherhood/paternity, disposition of property/possessions, etc. It /factual marital cohabitation/ will be registered after filling an application from both partners to the mayor or the city hall in the place of domicile. The institutionalization of the factual cohabitation responds to the social necessity and the wide spread practice of marital cohabitation without actually having a wedlock. Drafting a new Family code is determined by the substantial changes in the public-economical and social relationships. The present Family code is from 1985 and has only been changed once in 2003 when adoption matters were rearranged. In the new code are initiated a lot of changes like: the monetary deposit will no longer be a part of the common property, the spouses will be able to use a mediator for the consequences of the divorce and the 3 year term for mutual consent for divorce will no longer apply.
