The Bulgarian Constitutional court started proceeding against legislation that allows only master degree pharmacists to own chemist’s shops

The Constitutional court let the examination of claim filed by the national ombudsman for proclaiming for unconstitutional a text from the Medicinal Products in the Humane Medicine Act stating that only master pharmacist are allowed to manage and own pharmacies. Some of the constitutional judges have signed the definition with special opinion. In the middle of the past month the ombudsman Giniyo Ganev filed a claim to the court for proclamation of art.222 from the act for unconstitutional because according to him it violates the freedom of economic initiative. Meanwhile the government passed amendments in the act by which the requirement drops out and now is imminent the amendments to pass through National assembly. The Association of pharmacy's owners and the Bulgarian pharmacy union which are constituted for interested parties under this case are arguing constantly. The Association of pharmacy's owners was against the restriction since passing the act last year, while the Bulgarian pharmacy union is defending it. The dropping of this requirement foresees amendments in the Medicinal Products in the Humane Medicine Act which are in process of discussion in the Parliament.
